Visa Cancellation in the UAE: Employees, Closures and Grace Periods

Visa cancellation UAE employers carry out onshore starts with MoHRE cancelling the work permit and ends with ICP or GDRFA Dubai cancelling the residence and Emirates ID. The leaver then has a grace period that ICP now sets by category, from 30 to 180 days. Dependants, closures and abandonment reports each add their own rules.
Key pointGrace periods are no longer one-size-fits-all: ICP lists 180 days for Golden, Green and Blue holders, 90 days for skilled levels 1 to 3 and property owners, 60 days for sponsored permits and 30 days otherwise.
At a glance
Two cancellations onshore
The employer cancels the work permit and contract with MoHRE first, then applies to ICP or GDRFA Dubai to cancel the residence visa and linked Emirates ID.
Grace periods by category
ICP publishes grace periods of 180, 90, 60 or 30 days after cancellation or expiry, depending on the type of residence and the holder's category.
Overstay is fined daily
ICP lists a fine of AED 50 per day for remaining in the UAE after the applicable grace period following expiry or cancellation of residence.
Dependants go first
Family members sponsored by the worker must be cancelled before the worker's residence, placed on hold, or covered by a guarantee where ICP's conditions are met.
Abandonment has conditions
MoHRE's rules allow a work abandonment report after more than seven consecutive days' unexplained absence where the worker cannot be located or contacted.

Visa cancellation UAE employers and sponsors must handle is a two-stage process onshore: first the Ministry of Human Resources and Emiratisation (MoHRE) cancels the work permit and employment contract, then ICP or, in Dubai, GDRFA Dubai cancels the residence visa and the linked Emirates ID. Once cancelled, the former resident has a grace period to leave or change status, which now depends on the category of visa held.
This guide covers employee exits, company closures, dependants, the grace periods published by ICP, overstay fines, and the absconding (work abandonment) process that is often misused. It reflects official sources as of October 2026. Fees and procedures change frequently, so confirm the current position with the authority before acting.
The short answer: how visa cancellation UAE rules work
Only the sponsor can normally cancel a residence visa. The government portal explains that an employer must first apply to MoHRE to cancel the labour contract and work permit, with the employee signing the application, and then apply to ICP to cancel the visa. MoHRE also expects a statement signed by the employee confirming receipt of wages and end-of-service benefits.
After cancellation, the clock starts on a grace period. ICP now publishes different periods for different categories, ranging from 30 to 180 days. Anyone still in the country after the grace period ends is fined for each day of overstay.
| Category | Grace period | Examples |
|---|---|---|
| Golden, Green and Blue residence holders and their family members | 180 days | Long-term visa holders leaving an employer |
| Widows or divorced women of residents, students after completing studies, foreign-passport relatives of UAE citizens | 180 days | Family and education categories |
| Skilled workers in levels 1 to 3, and property owners | 90 days | Professional and managerial employees |
| Permits issued with a guarantor or host | 60 days | Sponsored residents in other categories |
| All other categories | 30 days | Residual categories |
GDRFA Dubai's own cancellation service page refers to a 60-day grace period after cancellation or expiry. Where the published figures differ, check the specific category with the issuing authority before the employee relies on a date.

The legal framework
Residence is governed by Federal Decree-Law No. 29 of 2021 Concerning Entry and Residence of Foreigners and its executive regulations, which provide the basis for the grace periods and overstay fines. Employment is governed by Federal Decree-Law No. 33 of 2021 on labour relations and its implementing resolutions, which set out when and how a work permit ends.
MoHRE's procedural rules on work permit cancellation, complaints and work abandonment reports are set out in Ministerial Resolution No. 47 of 2022, which the government publishes in an unofficial English translation. Check for later amendments before relying on its detail.
Free zones, the DIFC and ADGM
Free zone employees follow the same immigration rules, but the employment side of visa cancellation UAE free zones handle is run by the free zone authority rather than MoHRE. The free zone cancels the employment permit or card and submits the residence cancellation, and its own clearance requirements, such as returning access cards and settling outstanding fees, usually apply before it will act.
The DIFC and ADGM apply their own employment laws, with end-of-service and notice rules that differ from the federal law, and visa cancellation is processed through each centre's government services team. The immigration consequences, including the grace period and overstay fines, are the same as for onshore employees.
Who can start a cancellation
The sponsor starts the process: the employer for employees, the head of family for dependants, and the company for its partners and investors. ICP also lists an exceptional cancellation route where there are disputes or the sponsor has died, for which a separate fee applies. Where a long-term visa holder's residence is self-sponsored, as is common for Golden Visa holders, the employer does not control the residence; it ends the employment and the work permit, and the residence continues on its own terms.
Cancelling an employee's visa step by step
For an onshore employee leaving a mainland company, the usual visa cancellation UAE sequence is as follows. Our guide to termination of employment covers the contractual side.
- Settle the exit terms. Agree the last working day, notice and final settlement, including end-of-service gratuity and accrued leave.
- Cancel dependants first. ICP requires family members' permits under the worker's sponsorship to be cancelled before the worker's own residence, unless they are placed on hold or a guarantee is lodged.
- MoHRE cancellation. The employer submits the work permit and contract cancellation through MoHRE channels, with the employee's signature and the statement confirming receipt of dues.
- Immigration cancellation. The employer applies to ICP or GDRFA Dubai to cancel the residence permit and linked Emirates ID. GDRFA Dubai asks for the MoHRE cancellation extract for private sector employees.
- Grace period starts. The former employee uses the grace period to leave, take up a new job or switch to another visa category.
- Close the file. Keep copies of the signed settlement, cancellation documents and the departure or status change record for the employee file.
Where the employee is moving to a new UAE employer, the new employer typically processes a status change within the grace period rather than requiring an exit. See our guide to end-of-service gratuity for the payment the employee will need to acknowledge.
Dependants and the family visa guarantee
Family members sponsored by an employee cannot remain on the file of a sponsor whose own residence has gone. ICP therefore requires their permits to be cancelled before the sponsor's, or placed on hold for a limited period for a fee.
ICP's published fee table also shows a guarantee for cancelling the sponsor's residence without cancelling family members' permits. It is available where the sponsor's change of status to another employer has been approved, the sponsor meets the salary and occupation conditions for all family members, the sponsor's permit is valid or within its grace period, and family members' permits have at least three months remaining.
For the sponsorship conditions themselves, see our guide to family sponsorship.
Visa cancellation UAE rules when a company closes
When a company is wound up, every visa it sponsors must be cancelled before the immigration file can close. ICP will only cancel the establishment card after the commercial licence has been cancelled, all fines are paid and workers have been cleared. For investors and partners, ICP lists a certificate of cancellation or waiver of the commercial licence among the documents for their own residence cancellation.
The practical order is therefore:
- Settle employees' final dues and cancel their work permits and visas, including dependants.
- Clear immigration and labour fines on the company's files.
- Cancel the trade licence with the economic department or free zone.
- Cancel the establishment card with the cancelled licence attached.
- Cancel the partners' and investors' own residence, unless they are moving to another sponsor.
Getting this out of order is the most common reason visa cancellation UAE closures drag on for months. Our guide to closing a company in the UAE and our company liquidation practice cover the corporate side.
Before cancelling an owner's investor or partner visa, confirm where the owner and their family will hold residence next. The grace period starts on cancellation, and family visas usually fall with the sponsor's.
Absconding reports and work abandonment
The term "absconding" is still widely used, but MoHRE's rules now speak of an unexpected work abandonment report. Under Resolution No. 47 of 2022, an employer may register one where a worker is absent without lawful reason for more than seven consecutive days, the employer does not know the worker's whereabouts and cannot communicate with them.
The consequences are serious. The resolution provides that a worker whose abandonment report is proven true is not granted a new work permit for one year. Separately, the labour law allows an employer to end the contract without notice where the worker is absent without legitimate reason for more than 20 non-consecutive days in a year or more than seven consecutive days, as summarised on the government's page on terminating employment contracts.
The resolution also lists grounds for cancelling a report, including where seven consecutive days had not actually passed, the worker was present or on lawful leave, the parties had agreed to end the relationship, or the employer had allowed the worker to stop work or look for another job. A report filed to avoid paying end-of-service dues, or to block a resignation, is exposed on precisely these grounds.
Workers can also apply for cancellation of their own work permit without the employer's consent. The resolution gives MoHRE a short window to reach the employer before completing the cancellation at the worker's request, unless the employer shows the worker is under investigation for a work-related crime. Disputes then move to MoHRE and, if unresolved, to the labour courts; see our employment disputes practice.
Illustrative scenario: redundancy at a mainland trading company
This scenario is illustrative and does not describe a real client. A Dubai trading company restructures and makes four roles redundant. Two employees hold standard employment visas, one is a skilled professional sponsoring a spouse and child, and one holds a Golden Visa while working for the company.
HR maps each leaver's visa cancellation UAE category, prepares final settlements and signed acknowledgements, then cancels the work permits through MoHRE. For the professional with a family, the spouse and child are cancelled first, as the employee has a new job offer and plans to resettle the family after the new visa issues. The employer diarises the grace period that applies to each person's category rather than assuming a single deadline.
The Golden Visa holder's position is different: the residence is not sponsored by the company, so the company cancels only the work permit and the employment relationship. A short exit memo to each employee setting out what has been cancelled and what they need to do next avoids overstay fines and unnecessary disputes.
Risks and common mistakes
Assuming the old 30-day rule applies to everyone
Grace periods were extended and differentiated. ICP now lists 180, 90, 60 and 30-day periods depending on category, and GDRFA Dubai's page refers to 60 days. Employers who tell every leaver they have 30 days may cause unnecessary rushed departures, while employees who assume they have 180 days may overstay. Check the category for each person and record the applicable deadline in the exit paperwork.
Cancelling the visa before settling dues
MoHRE's process expects a statement from the employee confirming receipt of wages and end-of-service benefits. Pushing a cancellation through before the final settlement is agreed invites a complaint, delays the cancellation and can lead to the work permit being cancelled at the worker's request instead. Agree and document the settlement, pay it, then cancel.
Filing an abandonment report as leverage
A work abandonment report must meet the conditions in Resolution No. 47 of 2022: more than seven consecutive days' unexplained absence, unknown whereabouts and no means of contact. Reports filed against employees who have resigned, are on leave or have agreed to leave can be cancelled, and the employer's credibility with MoHRE suffers. Keep evidence of attempts to contact the employee before filing.
Forgetting dependants and domestic workers
Family members under an employee's sponsorship must be cancelled first or placed on hold, and domestic workers sponsored by the employee are handled through MoHRE. Leaving dependants on a lapsed sponsor's file generates fines and blocks future applications. Include a dependants check in every exit and closure plan.
Cross-border angle
Visa cancellation UAE processes often happen while the employee is already abroad, for example at the end of a secondment or after a remote resignation. Arrange for the employee to sign settlement and cancellation documents electronically or through a properly authorised representative, and confirm with the authority whether the cancellation can proceed while the person is outside the country.
Group employers moving staff between the UAE and Bangladesh, India, the UK, Singapore or Saudi Arabia should plan cancellations around the start date in the next country, social security and tax residence. Our cross-border workforce planning practice coordinates these moves.
Overseas employees should also check how the cancellation date interacts with their home-country position. A leaver returning to a country that taxes on residence, or to a new employer that needs proof of release, will usually want a copy of the cancellation record and the final settlement. Ask for these at exit; obtaining them later from abroad is slower.
What to do next: a visa cancellation UAE checklist
- Identify each leaver's visa category and the grace period that applies to it.
- Prepare and pay the final settlement before submitting the MoHRE cancellation.
- Cancel dependants first, or arrange a hold or guarantee where eligible.
- Submit the MoHRE work permit cancellation, then the ICP or GDRFA Dubai residence cancellation.
- Use abandonment reports only where the legal conditions are met and documented.
- On company closure, cancel all visas before the licence, and the licence before the establishment card.
- Give each leaver a written note of what has been cancelled and the date they must leave or change status.

Frequently asked questions
01How long can I stay in the UAE after my visa is cancelled?
It depends on your category. ICP publishes a 180-day grace period for Golden, Green and Blue residence holders and their families and several family and student categories, 90 days for skilled workers in levels 1 to 3 and property owners, 60 days for permits issued with a guarantor or host, and 30 days for all other categories. GDRFA Dubai's page refers to 60 days. Confirm your category with the issuing authority and leave or change status before the period ends.
02Can I cancel my own employment visa?
Normally only the sponsor can cancel a residence visa. An employee who wants to leave should resign in line with the contract and ask the employer to cancel. If the employer refuses, MoHRE's rules allow a worker to request cancellation of the work permit without the employer's consent; MoHRE contacts the employer and can complete the cancellation within a short period unless there is a valid reason not to, such as a work-related criminal investigation.
03What is the fine for overstaying after visa cancellation?
ICP lists a fine of AED 50 per day for remaining in the UAE from the day after the grace period ends. The fine accrues daily until the person leaves or regularises their status. Overstay can also complicate future visa applications, so it is better to secure a new visa, a visit visa or departure within the grace period.
04What happens to my family's visas if my visa is cancelled?
Family members sponsored by you must normally be cancelled before your own residence is cancelled, or placed on hold for a limited period for a fee. ICP also offers a guarantee that allows your residence to be cancelled without cancelling theirs where you are changing to a new employer, meet the salary and occupation conditions and their permits have at least three months left.
05Can an employer file an absconding case after I resign?
A work abandonment report is meant for workers absent without lawful reason for more than seven consecutive days whose whereabouts are unknown and who cannot be contacted. MoHRE's rules allow a report to be cancelled where those conditions were not met, the worker was on lawful leave, or the parties had agreed to end the relationship. A worker facing an unjustified report should keep resignation correspondence and raise it with MoHRE promptly.
06How are visas cancelled when a company closes?
All employee and dependant visas must be cancelled first and fines cleared. The trade licence is then cancelled with the economic department or free zone, and ICP will only cancel the establishment card once the licence is cancelled, fines are paid and workers are cleared. Owners' investor or partner visas are cancelled with evidence of the licence cancellation unless they move to another sponsor.
